Man Freed 20 Years After Rape Conviction01/24/2011
The Hawaii Innocence Project has scored a big win. Thanks to their efforts, a Maui man who spent 20 years in prison for the rape of a woman during a burglary will get a new trial after a new DNA evidence cast doubt on his original conviction. A judge on Friday overturned the convictions of Alvin Jardine III, 41, who was sentenced to 35 years after the alleged victim identified him as the assailant. Prosecutors tried the case three times, ending twice in hung juries before a third found Jardine guilty in 1992. Jardine was released Friday after posting $75,000 bail, but it's unclear whether prosecutors will decide to retry the case.
